Elephant Enterprises LLC ("Elephant Enterprises," "we," "us," or "our") owns and operates TapVoice — an application and online platform providing users with resources for communication, education, and other uses (collectively, the "Platform").
By accessing or using any of our applications, websites, or services, you ("you," "your," or "user") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Platform.

Users aged 18 and over may register for and use the Platform independently.
Users aged 13 to 17 may use the Platform only with the consent and supervision of a parent or legal guardian. By allowing a minor to use the Platform, the parent or guardian agrees to these Terms on the minor's behalf and accepts responsibility for the minor's use of the Platform. Parents and guardians who create accounts on behalf of minors represent and warrant that they have the legal authority to do so.
Users under 13 are not permitted to use the Platform. We do not knowingly collect personal information from children under the age of 13. If you are under 13, please do not attempt to register for or use the Platform.
We reserve the right, in our sole discretion, to suspend or terminate any account and refuse any and all current or future use of the Platform.
Elephant Enterprises LLC grants you a limited, non-exclusive, fully revocable license to access and use the Platform for your own personal, non-commercial purposes. This license is personal to you and may not be assigned or sublicensed to anyone else. All rights not explicitly granted are reserved by us.
You agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of the Platform, including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.
The Platform is provided on an "as is" basis. No warranty is given about the quality, accuracy, functionality, availability, or performance of the Platform, and we reserve the right to suspend, withdraw, amend, modify, or vary the service provided without notice and without incurring any liability to you.
Except as expressly permitted by us in writing, you agree not to reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble the Platform. You will not take any measures to interfere with or damage the Platform. All rights not expressly granted by Elephant Enterprises LLC are reserved.
Downloading the Platform and completing our registration process will enable you to access additional functionality. You are solely responsible for your account and any activities that occur under it. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. Elephant Enterprises LLC will not be liable for any loss or damage arising from your failure to comply with this provision.
Certain features of the Platform may be available through paid subscriptions or one-time in-app purchases. If you purchase a subscription:
You are solely responsible for any content you submit, post, or generate through the Platform. You agree not to use the Platform to transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
You acknowledge and agree that Elephant Enterprises LLC may disclose your information if required to do so by law or in the good-faith belief that such disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms; (c) respond to claims that content violates the rights of third parties; (d) protect the rights, property, or personal safety of Elephant Enterprises LLC, its employees, users, or the public; or (e) facilitate a transfer or sale of the Platform to another entity.
Certain features of the Platform may use artificial intelligence or machine learning to generate, suggest, or assist with content (including but not limited to speech output, text suggestions, and educational exercises). AI-generated content is provided for informational and assistive purposes only and may not always be accurate or appropriate. You should review any AI-generated content before relying on it. We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.
The Platform may incorporate third-party content, libraries, and services. The Platform may also contain links to third-party websites or services that are not owned or controlled by Elephant Enterprises LLC. We assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
The design of the Platform, along with all text, templates, scripts, graphics, interactive features, and trademarks, service marks, and logos contained therein ("Marks"), are owned by or licensed to Elephant Enterprises LLC, subject to copyright and other intellectual property rights under US and foreign laws and international conventions. You agree not to engage in the use, copying, or distribution of anything contained within the Platform unless we have given express written permission.
By registering, clicking "Agree," submitting information, or using the Platform, you agree to be bound by these Terms. These Terms remain in effect until terminated.
Elephant Enterprises LLC may suspend, disable, or delete your account (or any part thereof) at our sole discretion. If your account is deleted, you may not re-register under a different name or identifier.
Upon termination, all licenses granted by Elephant Enterprises LLC will terminate. Content you submitted may no longer be available following account deletion, and Elephant Enterprises LLC shall not be responsible for the loss of such content.
Your use of the Platform is at your sole risk. We expressly disclaim any and all responsibility and liability for your conduct or the conduct of any other user, and expressly disclaim any liability for content uploaded by you or by any other user.
THE PLATFORM IS PROVIDED ON AN "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE" BASIS. ELEPHANT ENTERPRISES LLC, ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AND AGENTS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED, IMPLIED, OR STATUTORY, RELATING TO THE PLATFORM AND ITS CONTENT, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS.
ELEPHANT ENTERPRISES LLC DOES NOT WARRANT THAT: (A) THE PLATFORM WILL MEET YOUR SPECIFIC REQUIREMENTS; (B) THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE CONTENT VIEWED ON THE PLATFORM WILL BE ACCURATE, RELIABLE, OR COMPLETE; (D) ANY ERRORS IN THE PLATFORM WILL BE CORRECTED; OR (E) THE QUALITY OF ANY PRODUCTS OR SERVICES OBTAINED THROUGH THE PLATFORM WILL MEET YOUR EXPECTATIONS.
IN NO EVENT SHALL ELEPHANT ENTERPRISES LLC BE LIABLE FOR ANY DIRECT, INDIRECT, GENERAL, SPECIAL, EXEMPLARY, COMPENSATORY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM, INCLUDING WITHOUT LIMITATION UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS AND ERRORS, MISTAKES, OR INACCURACIES OF ANY CONTENT ON THE PLATFORM.
SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO THE ABOVE DISCLAIMERS AND LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
For jurisdictions that do not allow us to limit our liability, our liability is limited to the smallest extent possible by law. Specifically, we do not disclaim liability for: (a) death or personal injury caused by our negligence; (b) fraudulent misrepresentation; or (c) any liability that cannot lawfully be excluded.
WHERE PERMITTED BY APPLICABLE LAW, YOU AGREE THAT OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED $100 OR THE TOTAL AMOUNT YOU PAID TO USE THE PLATFORM WITHIN THE LAST TWELVE (12) MONTHS, WHICHEVER IS GREATER.
You understand and agree that you download or otherwise obtain material or data through the Platform at your own discretion and risk, and that you will be solely responsible for any damages to your device or loss of data resulting from the download of such material or data.
Informal Resolution. Before filing any formal claim, you agree to first contact us at help@tapvoice.ai and attempt to resolve the dispute informally for at least thirty (30) days.
Binding Arbitration. If we cannot resolve the dispute informally, you and Elephant Enterprises LLC agree to resolve any claims relating to these Terms or the Platform through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as set forth below. The arbitration will be conducted in the English language in the State of Delaware. Judgment on the arbitration award may be entered in any court having jurisdiction.
Class Action Waiver. YOU AND ELEPHANT ENTERPRISES LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Exceptions. Either party may bring claims in small claims court if the claims qualify. Either party may also seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Opt-Out. You may opt out of this arbitration provision by sending written notice to help@tapvoice.ai within thirty (30) days of first accepting these Terms. If you opt out, disputes will be resolved in the courts described in Section 14.
You agree to indemnify, defend, and hold harmless Elephant Enterprises LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law provisions. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Wilmington, Delaware.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top. For material changes, we will provide notice through the Platform or by other means. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
